What constitutes an Emotional Support Dog?
An Emotional Support Dog isn't merely a pet; it's a supportive companion offering therapeutic benefits to individuals with mental or psychiatric disabilities. Those seeking an emotional support dog must have a verifiable disorder or disability. Recognized as a "reasonable accommodation" under the Fair Housing Amendments Act of 1988, emotional support dogs enable individuals to live independently in housing communities with a "no pets" policy. Just as a wheelchair facilitates equal opportunity for those with physical limitations to enjoy a dwelling, an emotional support dog extends the same opportunity to those with mental or psychiatric disorders. Failure to accommodate reasonable requests, such as changing rules or policies, may constitute a violation of the FHA, unless such accommodation poses an undue financial burden or fundamental alteration to the premises. The United States Department of Housing and Urban Development (HUD) defines "assistance animal" as any animal providing assistance, performing tasks, or offering emotional support to alleviate identified symptoms or effects of a person's disability. Emotional support dogs fall under this category and are permitted as a reasonable accommodation in residences with a "no pets" policy, but they may not accompany their owners into establishments such as restaurants.
Identifying Emotional Support Dogs
The demand for Emotional Support Dogs has surged in recent years, enhancing individuals' quality of life through companionship in daily activities. Properly identifying your Emotional Support Dog ensures that your canine companion can accompany you wherever you go, with a few exceptions. Under Federal law, handlers cannot be charged fees for their accompanying Emotional Support Dogs, including pet rent in apartments and hotel fees. Our mission is to equip you with the necessary tools to seamlessly identify your companion as an Emotional Support Dog in all circumstances, backed by verification and expertise in Emotional Support Dog Law.
Qualification Criteria
Most Emotional Support dogs require no specialized training, although some may have minor behavioral and obedience training. These dogs are typically chosen for their gentle, calming temperament and may vary in size, age, or breed.
Emotional Support Versus Service Dog Certification
Distinguishing between an Emotional Support Dog and a Service Dog lies in their training. Has the dog undergone training to perform a task or job directly linked to the individual's disability? For instance, alerting a hearing-impaired person to an alarm or guiding a visually impaired person around obstacles are tasks performed by service dogs. Some dogs naturally exhibit these abilities, which can be recognized and enhanced through training if necessary. According to Federal Law, no one can demand that a Service Dog perform on command, and depending on State Law, a Service Dog in training enjoys the same privileges as a fully trained Service Dog.

How do airlines determine whether a dog is an Emotional Support animal?
Airlines ascertain whether a dog is for Emotional Support or as a pet by:
1. The credible verbal assurances of an individual with a disability using the animal;
2. Observing physical indicators such as the presence of a harness or tags;
3. Requesting documentation for psychiatric support animals and emotional support animals; and
4. Observing the behavior of the animals.
